Minor revisions have been made to Key Requirements 4.1, 4.8 and 4.15 in Guidance Note 10 Business Continuity and Disaster Recovery (GN10) for the ASX Clear, ASX Clear (Futures) and ASX Settlement Operating Rules and to Key Requirements 4.1, 4.8 and 4.13 in GN10 for the Austraclear Regulations.

Nominated Business Continuity Officer (Key Requirement 4.1) – changes applicable to ASX Clear, ASX Clear (Futures) and ASX Settlement participants make it clear that the participant’s nominated business continuity officer may act as ASX’s primary point of contact for discussions related to the participant’s disaster recovery and business continuity arrangements and any disruptions that may occur, or may appoint another person with the requisite knowledge and skills (a “primary business continuity contact”) to perform that role. Text has been added noting that a participant should notify ASX within 10 business days of the appointment and any subsequent departure of its nominated business continuity officer and any other primary business continuity contact.

Changes applicable to Austraclear participants provide that when initiating contact with a participant regarding disaster recovery and business continuity arrangements, representatives of Austraclear would in the first instance contact one of the participant’s authorised signatories to confirm the identity of the nominated business continuity officer. Subsequent discussions regarding business continuity and disaster recovery arrangements would then be held between representatives of Austraclear and the nominated business continuity officer.

Connectivity requirements (Key Requirement 4.8) – changes applicable to ASX Clear and ASX Clear (Futures) only are intended to remove any doubt that a participant can share connections to the clearing facility with other participants that are related bodies corporate.

Notification requirements (Key Requirement 4.15) – changes applicable to ASX Clear, ASX Clear (Futures) and ASX Settlement participants provide for ASX to be notified of the appointment and any subsequent departure of a participant’s nominated business continuity officer and any other primary business continuity contact via email to review.team@asx.com.au.

Notification requirements (Key Requirement 4.13) – changes applicable to Austraclear participants remove the requirement for Austraclear participants to notify Austraclear of changes to their nominated business continuity officer.
