Guidance Note 5 is being amended to reflect updates to the legal framework within which Depositary Nominee services are provided by CHESS Depositary Nominees Pty Limited (CDN) in respect of CHESS Depositary Interests.
On 2 April 2026, ASX received regulatory clearance in respect of amendments to the ASX Settlement Operating Rules including to section 13 Depositary Interests in CHESS which are to take effect on 1 May 2026. Those Rule (and associated Procedures) amendments, together with the introduction of Nominee Terms by CDN and other contractual arrangements, are intended to update the legal framework. The amendments to Guidance Notice 5 reflect the updates to the legal framework.
The amendments to the Guidance Note also include recognition of the introduction of fees for CDN’s services and some minor updates to the Guidance Note.

The amendments to the Guidance Note will take effect from 1 May 2026 and the updated Guidance Note will be available via ASX Online and on the ASX Listing Rules page on the ASX website.
CDI issuers should familiarise themselves with the amendments to the Guidance Note.
