On 2 December 2024, ASX released its Response to Consultation on the amendments it proposed in May 2024 to the ASX Clear Operating Rules and Procedures, the ASX Settlement Operating Rules and Procedures, and the Austraclear Regulations and Procedures.  The amendments related to the five-year review and refresh of the clearing and settlement facility rule books and were undertaken to:

  • Reflect current practice (or practices that have evolved over time)
  • Support continued compliance with the licence obligations of the ASX Clearing and Settlement facilities
  • Align common elements across the rulebooks
  • Provide greater accuracy, transparency and clarity
  • Delete redundant rules and references

The amendments have now received regulatory clearance and will take effect on Monday 21 September 2026. 

There have been no material changes to the amendments included in ASX’s response to consultation.  A copy of the amendments in the three rulebooks is available below.

Austraclear Regulations and Procedures

To ensure alignment across all the rulebooks, the amendments to the ASX 24 Operating Rules and ASX Clear (Futures) Operating Rules which were deferred when those rulebooks were updated in February 2026 will also come into effect on 21 September 2026 as well as changes to ASX Operating Rules.  A copy of these amendments is available here

What's changing?

Key amendments include: 

  • extending the timeframe for ASX, ASX 24, ASX Clear and ASX Clear (Futures) participants to notify the appointment, resignation or removal of a director from 10 days to 28 days.
  • a new requirement for ASX Clear and ASX Clear (Futures) participants to notify the appointment and any subsequent departure of their primary and secondary recovery contacts (noting participants will have 28 days from the 21 September 2026 to lodge these contacts).  
  • a new requirement for ASX Clear (Futures), ASX Clear and ASX Settlement participants to notify the appointment and any subsequent departure of their nominated business continuity officer and any other primary business continuity contact within 28 days of the change taking effect. 
  • the addition of connectivity requirements in the Austraclear Regulations that reflect the obligations set out in Guidance Note 10 – Business Continuity and Disaster Recovery, and an update to the thresholds for participants required to maintain an ASX Net Connection, together with a clarification of the participants to which that requirement applies. 
  • a new express power allowing ASX Clear to sell a defaulter’s portfolio rather than auction or close out (which aligns with ASX Clear (Futures)’ powers which were implemented in February 2026).
  • a new express power allowing Austraclear to require the withdrawal of security where Austraclear considers there is non-compliance with the relevant anti-money laundering, terrorist financing or financial sanctions legislation.
  • an amendment to an existing ASX Clear power to recognise that ASX Clear may need to take action if an undesirable situation or practice develops that is contrary to the operation of a fair and effective clearing and settlement facility or contrary to the reduction of systemic risk in the Australian financial system (which aligns with ASX Clear (Futures)’ powers which were implemented in February 2026).

What do I need to do by when?

Participants should review the rule amendments and ensure you are in a position to comply with your obligations on and from Monday 21 September 2026.

Participants Supervision will make the new Recovery Contact form available to support the rule changes. 

Effective date

These changes will take effect on and from Monday 21 September 2026.
